Ask for a goodwill deletion if you paid the collections. Get information on the debt from two places: your credit reports and your own records.
Until April 20, , you can get a free credit report every week from each of the three major credit bureaus by using AnnualCreditReport. In addition, you can check your free credit report at NerdWallet as often as you like, along with a free credit score, both from TransUnion. Gather your own records for details on the account, including its age and your payment history. Between the two, verify these details:. Account status paid, charged off, closed. The date the debt went delinquent and was never again brought up to date.
Once you have the details straight, you can decide which approach works for you. Too old to be reported: Delinquent accounts should fall off your credit report seven years after the date they first became and remained delinquent. For debts that linger longer than they should, file a dispute with any credit bureau that still lists the debt. Then, file a dispute by using the credit bureau's online process, by phone or by mail. The bureau has 30 days to respond.
Note that you have 30 days from the date the collector first contacted you to dispute the validity of the debt.
Follow up to make sure. I have a serious problem. I decided in November of to file bankruptcy myself. Well after filing all my paperwork and taking the first bankruptcy filing class, all was well.
At my meeting of creditors a situation came up that pro longed my filing. Well in that time I did not take the second class. So my bankruptcy was dismissed without discharge. I than decided not to do it myself and file through a lawyer which was done in discharged. Now both bankruptcy shows on my credit report as if I filed in November of and September of How do I get the bankruptcy off that was dismissed but not discharged.
Hi Ryan. I rented a car recently. Upon returning the vehicle, the door handle damage was noted and I acknowledged responsibility. A month later, I received a claim from the rental company for damage to the handle and also damages that did not occur while the vehicle was in my possesion. I have not had success after repeateded attempts to dispute the additional damage.
I will pay for the handle, but not the other damage. As this may end up going tpo a collection agency, is there any preemtive action I can take? How much are the damages? I know there are principles involved, but sometimes you have to step back and look at the big picture. A collection on your credit report is not a fun thing to deal with. I have a question. I have a 60 day late notice for a creditor on my credit reports. I am currently trying to purchase a home and need them removed.
Is this true? What else can I do to get this negative item removed? Try one of the methods I outline Here. Hi, I work for a credit agency and its never illegal for them to removed any negative information from your credit report. Right now is a good time to ask the creditor if they take a settlement they will remove it from your credit. Its tax time now and a lot of them doing it. Can you help. One collection agency keeps hitting my credit score every 3 months since March This was actually defaulted back in I already explained to the bank and the first agency the reason for not paying the bill and had a credit hit in So I just ignored it.
Recently, I realized after pulling credit report this RMCB is hitting my credit score every 3 months. Is it legal and correct? For the bill, it was already reported to credit bureaus in , why are they coming back and hitting again and again? Please suggest. I recently moved out of my apartment. Management told me if I left by a certain date, they would just bill me the balance. I never received anything from them. No call or bill. After trying to contact them numerous times over the last two months, I finally got in touch with the property manager.
Long story short, she sent my account to a collection agency. The fees arent anywhere in the lesasaThe balance and charges are9incorrect and showing up in my rental history. Hi, So I wrote a goodwill letter to the creditor of an apartment I had to break my lease with.
All they could do is send me a letter stating that the account had been paid in full. Where do I go from here? I wrote a letter to the collection agency with a full payment check telling them that by cashing the check they were agreeing to remove the item from my credit report.
I told them that not reporting it accurately would result in action from my attorney. They wanted the money so it worked like a charm. Sam, you should also write a letter to all three credit reporting agencies saying that you dispute the debt. If the collections company cannot verify the debt than the reporting agencies will remove it from your report. I would send letters every week until it is removed.
The collections agency has to validate the debt every time you send letters — if they miss even one time or cannot validate it the reporting agencies will remove the debt. I am not allowed to give legal advice but this is something we tell our clients — so you may want to call an attorney to ask — most usually allow an initial phone conversation free of charge.
I recently had an account with Sprint Mobile. The bill was in dispute. I kept telling Sprint the balance was wrong, they fixed the balance several times, Sprint said they would call me with updates, they never did. I had to keep calling them. One day I get a letter from a collections company on behalf of Sprint. I called Sprint and finally squared the balance out and paid it off with Sprint, not the collection company.
I never had any contact with the collection company nor did I know Sprint was going to send my account to a collection company. I paid Sprint after we finally found out what the real balance was.
Now, legally, how can this collection company hit my report when in fact I never even dealt with them nor did I pay them, I paid Sprint. This has got to be illegal since they had nothing to do with any type of collections with me, they never even called me nor did I speak to them on the phone.
How do I get this false listing removed? Thank you. After discussions I found that my account is in collection agency. I paid the balance off and kindly asked them written to remove the collection from credit report. It took some time and the collection desapared boosted my score. Thanks for advice.
Thanks for this comment. I paid a VZW bill that my brother had in my name. It is still on my report but I would like to get it off. I have an ongoing collection Best Buy card that my father had put into my name has happened many times before of course that being said I cannot dispute it as not being my account due to him putting it into my name. I could say it is fraud but here is the issue, my father passed away a couple years ago.
I have reached the point where I just want to go ahead and pay it off but I would also like it completely removed from my credit history like it never happened , is that even possible? Get everything in writing. It means I should ask them to send me a notes that I paid completely and they will remove all bad marks from my credit history,it that correct?
Every year I run my free report and dipute new things. This year I am working on asking nicely for the things that were not removed last year to be removed. These are easy to find documents just google them. I have a serious question. I am dumb when it comes to hospital bills. Meaning that when u r seen, I did not realize there was a hosp bill plus separate dr bills. I was unemployed at the time and sought financial assistance with hosp.
Faxed app in and never heard back or received another bill. I did receive 2 seperate dr bills and contacted the hosp back an they told me that my whole hosp file was submitted to financial assistance co and they should take care of those as well. Since then i have not received any further bills or collections or anything from the individual drs. I pulled my credit report today as my financial situation is better and gettin ready to buy another home.
Mine is already up for sale. The one dr bill hit my report last week without me knowing it or being notified of unpaid bills and my score dropped from to !!! This was crushing!!! What can I do about this?? The report showed that is did go to collections but I have never received anything. I am going to try the goodwill method. But any better or quicker solution to this unfairl reporting?? And IF I am successful in gettin it removed will they return my score to where it was and it not how long will it take to get my score back up??
This has hurt my family very bad as we thought we had been doing the right things an paying everything on time. Plus, we r on the home stretch of selling house and needing another place to live an afraid we can not even get a loan bow with a score and if so, we wud not be able to afford the pmts. Also, in cases of true errors like a bad acct hitting ur report that does not belong to u and it lowers ur score, will they return ur score to where it was prior to the bad reporting?
My credit took a point hit about 3 months ago when an unpaid bill showed up on my credit report. In calling the agency they said it was for a medical bill in the state I went to college in from August …how can 5. Also the current collection agency has requested information on the mysterious bill to be mailed to me. I have made two requests over 3 months and nothing has been reported back to the collection agency from the hospital — they wont tell me what hospital it is either. I am in a situation where I have asked the collection agency to forgive my credit report and remove the mark if I make full payment ASAP.
I was told by the woman that according to the fair credit reporting act that she cannot even legally do that? I really do not want to make full payment until I can reach some type of agreement with them. Should I work with the original creditor to see if I can make good with them?
Also, do I need to work with the original creditor regardless because the were the ones who were owed the debt if I in fact want to clear this of my record? I just want to get this wrapped up and also cleared up if possible. I currently have never had and still have only this mark on my credit report along with one late payment on a credit card from years back.
I would hate to see that screwed up because of this, thanks in advance for your help. I can only speak in my case, but I got three liens removed from the previous state I lived in.
Some of the courts require a letter in writing and may charge you a fee to send them to you. Once you get them, submit copies to the credit bureaus, along with a letter disputing that they should be reflected in your report and include the letters from the court.
In my case, I had all of them removed because I could back up the information. Just an idea. Hi, Thanks for sharing your experience. Did you write the goodwill letter to the credit bureau or collection agency? I had a hospital bill that got lost on me and went to collections. I paid the bill a little over 3 years ago knowing it would be on my credit but not knowing the full ramifications of that. I recently applied for a home loan and found that this was seriously damaging my ability to get a mortgage.
I came across this article today and I have to admit I never thought of this and I honestly thought it was a bit ridiculous. I tried it anyway and the collections company contacted me today to verify my address so they could send me a letter of removal. This method may not work, particularly if the debt is recent, but the potential benefit is more than worth sucking up your pride and almost begging for some help.

You need to send your letter to the creditor, not the credit agency. Just wondering can you get the state to remove tax leins after you have paid them off.
Probably not… Tax liens are one of those things that you usually just have to deal with. Leave a Reply Cancel reply Your email address will not be published. You are generally not legally responsible for paying another person's debts unless you have agreed to be a co-borrower or guarantor for a loan.
If you are considering becoming a co-borrower or guarantor, think carefully — if the person defaults on their repayments, you could be legally responsible for the full amount of the debt.
Creditors have the right to sue you to recover money owed to them. You can arrange this with the court staff. A defence is a legal reason why a debt cannot be enforced by a court. For example, there are laws that stop debts being collected through the courts after a certain period of time.
You should seek legal advice before doing this. Remember: you might still be able to negotiate a repayment plan, even if a court order has been made against you. Some old debts cannot be recovered by a debt collector. If you are contacted about a debt that's several years old, do not confirm the debt or make a payment until you get independent advice. You might have a defence against a debt if:.
Generally, you can rely on this defence if six years have passed since you last made a payment or confirmed the debt, and there is no court judgement against you. In the Northern Territory, the time period is three years.
